Thank you for visiting https://www.unifrog.org (the “Unifrog Website”). The Unifrog Website is a website operated by Unifrog Education Limited (“Unifrog” / “we” / “our” / “us”). It includes the “Unifrog Platform”, which is the part of the Unifrog Website which you can only access if your school has an account with us.
We are registered in England and Wales under company number 08231699 and have our registered office at 71-75 Shelton Street, London, WC2H 9JQ. Our VAT number is 160 4858 06.
The following terms and conditions (“Terms”) govern your use of the Unifrog Website and you should read them carefully before using this website. In particular, for details on the cookies we use and how to change your browser settings, please see our Cookie Policy below.

WHO DO THESE TERMS APPLY TO?
These Terms apply to:
- “Visitor(s)” to the Unifrog Website, i.e. someone who visits and/or uses the Unifrog Website but who does not access the Unifrog Platform;
- “Student(s)” using the Unifrog Platform, i.e. someone who uses the Unifrog Platform to help plan their further education or career, for example, to search and compare educational courses, apprenticeships and training opportunities and to draft and upload personal statements and CVs;
- “Teacher(s)” using the Unifrog Platform, i.e. someone who uses the Unifrog Platform in a teaching or supervisory capacity, for example, to provide feedback, opinions or comments on Students (and review feedback, opinions or comments provided by other Teachers), to review Students’ academic performance, activities and/or comments, to set target actions for Students and/or to act as a counsellor for university applications;
- “Other School Staff”, i.e. someone who has been given administrative access rights to the Unifrog Platform and is using the Unifrog Platform to administer Students’ use of the Unifrog Platform and carry out supervisory tasks.
- “Referee(s)” using the Unifrog Platform, i.e. someone who uses the Unifrog Platform in the capacity of writing recommendations, references or leaving similar types of feedback regarding Students.
Unless we say otherwise, these Terms apply to all Visitors, Students, Teachers, Other School Staff and Referees.
WHAT DO THESE TERMS COVER?
These Terms include:
- Our Terms of Use, which govern the use of the Unifrog Website;
- Our Acceptable Use Policy, which sets out the permitted uses and prohibited uses of the Unifrog Website. When using the Unifrog Website, you must comply with this Acceptable Use Policy.
- Our Cookie Policy, which sets out information about the cookies on the Unifrog Website.
These Terms also refer to our Privacy Policy, which sets out the terms on which we process any personal data we collect from you, or that you provide to us.
We may amend these Terms from time to time. Please check these Terms regularly to ensure you understand the terms that apply at that time.
1. Website Terms Of Use
ACCESSING THE UNIFROG WEBSITE
You may access and use some areas of the Unifrog Website as a Visitor. However, certain areas of the Unifrog Website (the Unifrog Platform) are only accessible to you if you are a Student, Teacher, Other Staff Member or Referee.
By using the Unifrog Website, you confirm that you accept these Terms of Use and that you agree to comply with them.
If you do not agree to these Terms of Use, you must not use the Unifrog Website.
WE MAY MAKE CHANGES TO THE UNIFROG WEBSITE
We may update and change the Unifrog Website from time to time to reflect changes to, for example, our users' needs or technical, operational or other business priorities.
WE MAY SUSPEND OR WITHDRAW THE UNIFROG WEBSITE
We do not guarantee that the Unifrog Website, or any content on it, will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of the Unifrog Website for business, technical and/or operational reasons. We will try to give you reasonable notice of any suspension or withdrawal.
We will not be liable to you if, for any reason, the Unifrog Website is unavailable at any time.
YOU MUST KEEP YOUR ACCOUNT DETAILS SAFE
If you choose, or you are provided with, a user identification code, username, password or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party.
We have the right to disable any user identification code, username or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these Terms of Use.
If you know or suspect that anyone other than you knows your user identification code, username or password, you must promptly notify us at info@unifrog.org.
HOW YOU MAY USE MATERIAL ON THE UNIFROG WEBSITE
We are the owner or the licensee of any and all intellectual property rights in the Unifrog Website and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.
You may print off one copy, and may download extracts, of any page(s) from the Unifrog Website for your personal use.
You must not modify in any way the paper or digital copies of any materials you have printed off or downloaded, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text. However, if you are a Teacher:
- you may edit teaching resource materials obtained from the ‘Resources library’ tool on the Teacher side of the Unifrog Platform, but only for education purposes at your school or college (“your School”); and
- you must not publish or share (whether online or otherwise) any materials from or derived from the Unifrog Platform, except:
- strictly within your School and its systems, to ensure that they cannot be accessed by people outside your School; or
- where a parent of a Student has requested that your School shares personal, social, health and economic (PSHE) resources with them.
- strictly within your School and its systems, to ensure that they cannot be accessed by people outside your School; or
Our status (and that of any identified contributors) as the authors of content on the Unifrog Website must always be acknowledged.
You must not use any part of the content or materials on the Unifrog Website for commercial purposes without obtaining a licence to do so from us or our licensors.
If you print off, copy or download any part of the Unifrog Website in breach of these Terms of Use, your right to use the Unifrog Website will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.
DO NOT RELY ON THE INFORMATION ON THE UNIFROG WEBSITE
The content which we provide on the Unifrog Website is provided for general information only. It is not intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on the Unifrog Website.
Although we make reasonable efforts to update the information on the Unifrog Website, we make no representations, warranties or guarantees, whether express or implied, that the content on the Unifrog Website is accurate, complete or up to date.
WE ARE NOT RESPONSIBLE FOR WEBSITES WE LINK TO
Where the Unifrog Website contains links to other sites and resources provided by third parties, these links are provided for your information only. We have no control over the contents of those sites or resources.
USER GENERATED CONTENT IS NOT APPROVED BY US
The Unifrog Platform may include information and materials uploaded by Students, Teachers, Other School Staff or Referees, including in personal statements, CVs, records of interactions, target actions, feedback, opinions and comments. This information and these materials have not been verified or approved by us. The views expressed by Students, Teachers, Other School Staff or Referees on the Unifrog Website do not represent our views or values.

UPLOADING CONTENT TO THE UNIFROG PLATFORM
Whenever you make use of a feature that allows you to upload content to the Unifrog Platform, or to otherwise make content available to other Students, Teachers, Other School Staff and/or Referees, you must comply with the content standards in our Acceptable Use Policy.
We have the right to remove any content you post or upload to the Unifrog Platform if, in our opinion, that content does not comply with the content standards set out in our Acceptable Use Policy.
When you submit comments, opinions or other feedback to us about the Unifrog Website, you agree that we can use and share (but do not have to) such feedback for any purpose without compensation to you.
WE ARE NOT RESPONSIBLE FOR VIRUSES AND YOU MUST NOT INTRODUCE THEM
We do not guarantee that the Unifrog Website will be secure or free from bugs or viruses. You should use your own virus protection software.
You must not misuse the Unifrog Website by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to the Unifrog Website, the server on which the Unifrog Website is stored or any server, computer or database connected to the Unifrog Website. You must not attack the Unifrog Website via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the Unifrog Website will cease immediately.
To the fullest extent permissible by law, we will not be liable to you for any loss or damage caused by a distributed denial-of-services attack, viruses, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of the Unifrog Website or to your downloading of any material posted on it, or any website linked to it.
RULES ABOUT LINKING TO THE UNIFROG WEBSITE
You may link to our home page or sign-in page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.
You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.
You must not establish a link to the Unifrog Website in any website that is not owned by you.
The Unifrog Website must not be framed on any other website, nor may you create a link to any part of our site other than the home page.
We reserve the right to withdraw linking permission without notice.
The website in which you are linking must comply in all respects with the content standards set out in our Acceptable Use Policy.

THE COMMON APP
If your School has agreed that its Unifrog accounts will be integrated with the Common Application (the “Common App”), you will be able to access the Common App via the Unifrog Platform.
If you use the Common App via the Unifrog Platform, the provider of the Common App service (The Common Application, Inc.), will receive and process some of your personal information. For further details, please see our Privacy Policy.
If you are a Teacher with lead responsibilities for submitting a student’s applications via the Common App (commonly referred to as a ‘Counselor’), and you use Unifrog's integration with the Common App, you must upload a PDF of the appropriate transcript for transmission with every school report, optional report, mid-year report and final report that you send via the Common App online. You understand that:
- if transcripts will be mailed, Common App member institutions do not want to receive the associated Common App reports online;
- uploading a blank document or a document promising to mail the transcript at a later time is not acceptable;
- if you fail to send the appropriate transcript with any Common App online reports, this may cause confusion and processing delays, resulting in a late application decision for the relevant application, and your Common App online account may be closed; and
- you agree that the provider of the Common App (The Common Application, Inc.) may contact you periodically regarding updates to the online school forms system, and will use the email address you use as your Unifrog username.
WHO YOU SHOULD CONTACT ABOUT YOUR PERSONAL DATA ON THE UNIFROG WEBSITE
Contact the person at your School who has responsibility for administering Unifrog.
WHICH COUNTRY'S LAWS APPLY TO ANY DISPUTES?
These Terms of Use, their subject matter and their formation, are governed by English law. You and we both agree that the courts of England and Wales will have exclusive jurisdiction except that if you are a resident in another jurisdiction, in which case you may also bring proceedings in your home jurisdiction.
In addition, please note that disputes may be submitted for online resolution to the European Commission Online Dispute Resolution platform:

SEVERABILITY
If any court or competent authority decides that any of the provisions of these Terms of Use are invalid, unlawful or unenforceable to any extent, the term will, to that extent only, be severed from the remaining terms, which will continue to be valid to the fullest extent permitted by law.
MISCELLANEOUS
Any words following the terms including, include, in particular, for example or any similar expression shall be construed as illustrative and shall not limit the sense of the words, description, definition, phrase or term preceding those terms.
2. Acceptable Use Policy
This Acceptable Use Policy sets out the content standards that apply when you upload content to the Unifrog Website, link to the Unifrog Website, or interact with the Unifrog Website in any other way.
PROHIBITED USES
You may only use the Unifrog Website for lawful purposes. You may not use the Unifrog Website:
(i) in any way that breaches any applicable law or regulation;
(ii) in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose;
(iii) for the purpose of harming or attempting to harm others in any way (including bullying, intimidating, abusing, threatening, harassing, defaming or violating any rights of another person, including Students and Teachers);
(iv) to send, knowingly receive, upload, download, use or re-use any material which does not comply with our content standards (set out below); or
(v) to knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.
You also agree not to:
(i) reproduce, duplicate, copy or re-sell any part of the Unifrog Website in contravention of the provisions of our Terms of Use;
(ii) access without authority, interfere with, damage or disrupt:
- any part of the Unifrog Website; or
- any equipment or network on which the Unifrog Website is stored;
(iii) access the Unifrog Website through accounts of other Students, Teachers, Other School Staff or Referees without permission, or misrepresent the source, identity, or content of information transmitted via the Unifrog Website or perform any other similar fraudulent activity;
(iv) upload files to the Unifrog Website that contain software or content protected by intellectual property laws (patents, trademarks, trade secrets, copyrights or other proprietary rights) or confidentiality, unless you own or control such rights or have received all necessary consents;
(vi) directly or indirectly transfer any data you receive from us to (or use such data in connection with) any social network or similar third party, even if a Student, Teacher, Other School Staff or Referee consents to such transfer; or
(vii) sell or distribute any information or content provided by or related to us or modify, adapt, translate or create derivative works based on statements or material on the Unifrog Website.
CONTENT STANDARDS
These content standards apply to any and all content which you post or upload to the Unifrog Website (contributions), including records of interactions with your Students or Teacher(s) and Teachers’ feedback, opinions and comments about Students, etc.
You must comply with the spirit and the letter of the following standards. The standards apply to each part of any contribution as well as to its whole.
Contributions must:
(i) be accurate (where they state facts);
(ii) be genuinely held (where they state opinions); and
(iii) comply with applicable law in the UK and in any country from which they are posted.
Contributions must not:
(i) contain any material which is defamatory of any person;(ii) contain any material which is obscene, offensive, hateful or inflammatory;
(iii) promote discrimination based on race, sex, religion, nationality, disability, sexual orientation, gender reassignment, pregnancy or maternity, marriage or civil partnership or age;
(iv) infringe any copyright, database right or trade mark of any other person;
(v) be likely to deceive any person;
(vi) be made in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidence;
(vii) promote any illegal activity;
(viii) be threatening, abuse or invade another's privacy, or cause annoyance, inconvenience or needless anxiety or be otherwise objectionable;
(ix) be likely to harass, upset, embarrass, alarm or annoy any other person;
(x) be used to impersonate any person, or to misrepresent your identity or affiliation with any person; or
(xi) give the impression that they emanate from us, if this is not the case.
If you see something on the Unifrog Website that you find objectionable or you believe breaches this Acceptable Use Policy, please promptly report it to us at info@unifrog.org. Please keep in mind that this does not guarantee that we will remove the content from the Unifrog Website.
BREACH OF THIS POLICY
We will determine, in our discretion, whether there has been a breach of the provisions of this Acceptable Use Policy. When a breach has occurred, we may take such action as we deem appropriate.
Failure to comply with the provisions of this Acceptable Use Policy, constitutes a material breach of our Terms of Use upon which you are permitted to use the Unifrog Website, and may result in us taking any or all of the following actions:
(i) temporary or permanent removal of any content you have uploaded to the Unifrog Website; and/or
(ii) disclosure of information to the police if we reasonably feel it is necessary.
The responses described in this Acceptable Use Policy are not limited, and we may take any other action we reasonably deem appropriate.

This cookie policy explains how we process personal information that we collect using cookies when you use this site (https://www.unifrog.org/) (the “Unifrog Website”, which includes the Unifrog Platform). This policy also explains what cookies are and how, as well as why, they may be stored on and accessed from your computer or device when you use the Unifrog Website.
1. INFORMATION ABOUT OUR USE OF COOKIES
- Strictly necessary cookies. These are cookies that are essential for the operation of the Unifrog Website. They include, for example, cookies that enable Students, Teachers, Other School Staff and Referees to log into the Unifrog Platform and remain logged in within the same browsing session. You may disable these by changing your browser settings, but this may affect how the Unifrog Website functions. This table provides more information about these cookies:
1.1 The Unifrog Website uses cookies (text files placed on your computer) which collect standard internet log information and visitor behaviour information.

2. THIRD PARTY WEBSITES’ COOKIES
The Unifrog Website provides links to websites that are controlled by third parties, such as Google Drive or Dropbox, which enable you to upload items to the Unifrog Platform; and to SurveyMonkey so that you can complete a survey or questionnaire. All these functions are optional. Google, Dropbox, and SurveyMonkey may use their own cookies. We do not have control over the placement of cookies by other websites, even if you are directed to them from our website. We recommend that you check their privacy policies and cookie policies for information about any cookies they use, and how they will treat your personal data. For example, SurveyMonkey may use cookies to market their services to you. They will also transfer your personal data to the US, where personal data is not protected to the same level as the UK/EU, so they have agreed to increase the protection for your information.
